Legal Terms, Conditions and Policies

Privacy Policy

Security
Easy IT uses encryption, firewalls and other security technology and procedures to help protect the confidentiality of your personal information and prevent unauthorized access or improper use thereof. All personal information is securely stored in Easy IT's Customer Database. Further more, all hosted data (email, web data, databases and passwords relating to the services) are only used internally and will at no point in time be provided to any third party without prior written authorization by you the legal owner of such data, with the exception being due to other lawful requirements.

Personal Information
For purposes of this Privacy Policy, "personal information means the Customer's name, surname, address, e-mail address, telephone number, cell phone number, ID number, physical address, company name, contact ID number, credit card or banking details."

Consent to Collection
By accepting the Easy IT Hosting Terms, the Customer consents to Easy IT's collection of personal information on an ongoing basis for the continued duration of the Customer's relationship with Easy IT, subject to the limitations set out in this Privacy Policy.

No Liability for Unauthorized Disclosure
While Easy IT will do all things reasonably necessary to protect the Customer's rights of privacy whilst on the Easy IT website, Easy IT cannot accept any liability whatsoever for unauthorized or unlawful disclosure of the Customer's personal and confidential information made by third parties who are not subject to Easy IT's control.

Types of Personal Information Collected
Easy IT collects personal information when a Customer submits an application form to make use of Easy IT's Services, or to respond to a Easy IT survey. If you choose to pay for the Services you order from Easy IT by way of debit order, Easy IT will request your banking details to include in the periodic debit order transactions. Easy IT also collects personal information for purposes of improving its Service offering and for purposes of increasing service efficiency.

Compliance with Applicable Law
Protecting Customer privacy is of utmost importance to Easy IT. Accordingly, Easy IT has developed this Privacy Policy in order to safeguard the Customer's personal information and to protect the confidentiality thereof. In so doing, Easy IT has taken cognisance of the provisions of the Constitution of the Republic of South Africa Act, 108 of 1996, the \ Electronic Communications Act, 25 of 2002 and the Protection of Personal Information Bill of 2006 (currently before the South African Law Commission) and the common law so as to ensure compliance with all relevant statutory requirements and best practice under South African law.

Customer Data
The Customer Data collected by Easy IT is used solely in connection with granting you access to the website, to any client self service control panel and for purposes of monitoring the Customer's use of the website so as to limit or prevent breaches of security.

Disclosure of Personal Information
Subject to your right to withdraw your consent in certain instances, you agree that we may obtain your personal information and use it, for certain specified purposes, including for, internal Easy IT marketing and contract administration as well as to enable us to collect your debit order payment. We will also provide personal information to law enforcement authorities in response to subpoenas and other lawful requirements where we believe that the disclosure of such personal information is necessary to identify, contact or institute legal proceedings against third parties who jeopardize the provision and rendering of the Services by Easy IT. Subject to your right to withdraw your consent in certain instances, you agree that we may obtain your personal information and use it, for certain specified purposes, including for, internal Easy IT marketing and contract administration as well as to enable us to collect your debit order payment. We will also provide personal information to law enforcement authorities in response to subpoenas and other lawful requirements where we believe that the disclosure of such personal information is necessary to identify, contact or institute legal proceedings against third parties who jeopardise the provision and rendering of the Services by Easy IT.

Retention of Personal Information
All personal information will only be retained for as long as it is necessary to fulfill the purposes mentioned in this policy 9 above.

Support customers
All support customers accept that Easy IT builds a "client information database" specific to each customer, over time. This database is based on the IT and ICT infrastructure of each individual customer and is used to ensure fast problem resolution, professional support and high service levels for that particular customer. This may include potentially sensitive information such as third party service passwords, passwords to secured areas of your network, third party account information etc. and might enable Easy IT to have full access to all company data, company databases, business plans etc. We do however guarantee the safety and security of this information under this agreement and will at no time provide it in whole or in part to any third party without prior written authorization from the customer involved, with the exception being other lawful requirements. We guarantee that this information is kept safe and secure at all times, is only used internally and will also not be provided to any third party in part or in whole even after the ending of a business relationship between Easy IT and the customer. The customer however agrees that this "client information database" is the sole property of Easy IT at all times. The customers' data however remains the customers' property at all times and does not form part of the "client information database" as described herein. We therefore agree that we will at no point in time, even after the ending of a business relationship between Easy IT and the customer, provide any form of data owned by the customer to any third party (in part or in whole) without the prior written authorization of the owner of the data, with the exception being other lawful requirements. We also guarantee that we will take all required action within our ability to ensure the security and integrity of such information.

Off-site and automated remote backups
Easy IT agrees that any data owned by any customer, stored on any medium at our offices or at any other location under Easy IT's control remains the property of the lawful owner at all times, will be stored in such a way as to ensure the data integrity and security and all possible action will be taken to prevent access to this data by any third party. All automated off-site backups are encrypted ensuring that only the customer and Easy IT can access this data remotely or otherwise and all operations on this data will be performed in such a way as to ensure the data integrity and security.

Easy IT endeavours to keep all customer information secure at all times and agrees that any customer data remains the property of the customer with the prerequisite that the customers account remains up to date.

Acceptable Use Policy

Introduction:

This Acceptable Use Policy ("AUP") records the terms upon which the users agree to utilize the services provided by Easy IT. It constitutes an undertaking by the users to the co-users, the client and to the service provider (Easy IT) to abide by the conditions stipulated herein. The AUP is a sever-able document and separate agreement from, but must be read with, any agreement between the client and the service provider ("the principal agreement") and any agreements between the service provider and any users of any services rendered by Easy IT. The AUP also details prohibited actions and applies to all Internet and/or network access and/or services ("services") utilized. Use of the services constitutes acceptance of and agreement to abide by all of the terms detailed herein. Violations of this AUP may result in immediate suspension and/or termination of the services by the service provider or the client.
Usage Guidelines and Terms:

Services may not be used in the furtherance of any illegal or unlawful activities. In amplification of the foregoing, and without limiting the scope thereof in any way, the user undertakes not to upload, download, post, distribute, facilitate, communicate or transmit any material in or to any chat room, message board, newsgroup, website and/or any similar medium accessed through the services which may constitute unauthorized and/or unlawful and/or illegal reproduction of any material protected by copyright, trademark, trade secret or other intellectual property right, as well as any material that is obscene, sexually explicit, degrading toward children or woman, or that may constitute an unlawful/illegal threat of any kind ( including any activity related to terrorism being electronic or otherwise). The user also undertakes not to use the services in an abusive and/or harassing, defamatory, deceptive, fraudulent way, and also undertakes not to invade another's privacy or fraudulently assume another's identity. The user further undertakes not to violate any South African or any foreign or any international export and import control laws and/or other legislation relating to the use of the service.
In conjunction with the above the user also undertakes to refrain from the following:

To probe or scan hosts or networks or breach security of hosts, network components, or authentication systems without the explicit permission of administrator(s) of such systems or networks; To monitor data or any network without the explicit authorization of the administrator(s) of such network or system; To use another Internet user or business's electronic mail server to relay mail without the explicit permission from that party (E-mail Relay); To fraudulently create data with the intent to misrepresent origin or source; To create data or network traffic that may or does result in damage to, or disruption of, a service or network connected device; To send unsolicited mass electronic mail messages to one or more recipients ("spamming"). Electronic messages which are sent in an unsolicited manner to 10 or more recipients, or any series of unsolicited electronic message to a single user, qualify as a prohibited action; Engaging in any activity that compromises or threatens the ability of the service provider to provide services in a reasonable and efficient manner. Examples of prohibited use include, but are not limited to, deliberate attempts to overload system and broadcast attacks that is intended to disrupt or disable any recipient system ("Denial of Service" or "DOS" or "Syn flood" attacks); to knowingly distribute computer viruses or other malicious computer programs; and/or to use or misuse the service provided in any way that could or does in fact prejudice any user or diminish the quality of the service to other users.

Additional terms:
In addition to immediate suspension or termination of the services, violation of the terms hereof may result in civil claims or criminal prosecution. Users who have their own internal network would need to maintain their own security or contract individually with the service provider to ensure that it complies with these standard rules, e.g. user names and passwords, firewalls, antivirus etc. Violations of this policy by a third party under the control or by facilitation in any way by any user are considered to be a violation by the user. The user will adhere to the policies as set forth herein in order to ensure equal fairness and quality of service distributed amongst all users. The web hosted services selected will remain effective for as long as the user/client remains the same and the Easy IT remains in a position to ensure this. The user indemnifies the service provider against any civil and/or criminal claims that might arise in consequence of the user's use of the services. The user also acknowledges that some of the services provided are dependent upon services provided by third parties and that the user will make allowance and contingency plans for the untimely interruption of services which cannot be guaranteed against by the service provider. The service provider administers and facilitates these services and acts as an intermediary. Users are responsible to acquaint themselves with the terms and specifications of any agreement entered into between the client and the service provider. Fixed IP addresses provided are not portable and may not be independently administrated, distributed or transferred. It is strongly recommended that the user protect their Internet devices from virus attacks, intrusion spyware and adware (software that transmits personally identifiable information from your computer.) Service Terms and Conditions

Support / Hardware / Service request terms and conditions:

Any written or electronically written request, acceptance of quote for any hardware / software / physical amenities or service by any existing or potential customer will be seen as a valid "request for service" and the customer may be held liable for any cost incurred in providing this service under our standard rates and terms and conditions. It is the customers responsibility to cancel any such requests with Easy IT (in writing) before any action is taken or any orders are placed with our suppliers. Any service report, or job ticket (signed or otherwise) will be seen as valid until such time as it is proven otherwise.

Invoice and Payment Terms and Conditions

All web services are payable in arrears within 7 days of any invoice therefore being issued and are subject to suspension or cancellation if not fully paid by the due date. All web services are subject to a "30 day" calendar month written cancellation. No cancellation will be accepted if not in a written or electronically written form. Certain web services may be subject to a "set up" fee not indicated in our pricing model and it is the customers responsibility to request such "quotations" in writing. Because web services are billed in arrears, should a customer be granted 30 days on their account, web services will be billed in advance.

All hardware, software and physical amenities are payable before delivery with a valid proof of payment required before delivery arrangements will be made. This proof needs to be submitted by email or fax to our accounts department well in advance of the requested delivery date, it is the customers responsibility to request and receive in writing any lead times required in this regard. Certain of these items may require a delivery charge that will be billed according to the specific requirements relating to the item and the delivery thereof. A handling fee will be charged on any returned item that is not deemed as faulty and this handling fee will be a minimum of 10% of the total value of the item involved. It is the customers responsibility to ensure that any quoted or ordered item meets the needs it is intended for. Easy IT will take no responsibility for any hardware incorrectly ordered or any items not suitable for the intended need of the customer unless expressly indicated in writing well in advance of its delivery or procurement. Easy IT however endeavours to provide as accurate representation of the items specifications and purpose as humanly possible.

Travel is charged at our indicated rates and is payable in arrears within seven days of invoice.

Specialized services may require different payment methods and schemes, it is the customers' responsibility to obtain (in writing) such terms and conditions prior to the services provided.

All labour, including support services and special case web service modifications, is payable in arrears within 7 days of invoicing. Because labour is only invoices every 30 days, a 30 day account can only be granted as part of an SLA between Easy IT and the customer. It is the customers responsibility to either familiarize him or herself with the Easy IT's billing model or to receive an appropriate quotation for any services rendered before any requested labour is performed.

All provided hardware, software and services remain the property of Easy IT in whole until such time as the total outstanding amount on any outstanding invoices is paid in full. The customer cannot elect to pay certain sections or invoices first and in certain cases any payment from the customer will be seen as a partial payment on all outstanding invoices at that time. Payments under normal circumstances are however listed against the oldest invoice first.

SLA customers may receive certain extended payment privileges in various regards, including bulk discount, extended hardware terms, extended labour and service terms etc. It is however the customers' responsibility (SLA or otherwise) to obtain any such extended terms from Easy IT in writing before such extended terms will come into effect.

Interest will be charged on any outstanding balances (seen as payments not reflecting in Easy IT's bank account) at 2% of the outstanding amount, 5 (five) days after payment was due. We therefore advise customers to make payment well in advance to ensure that the funds reflect in Easy IT's bank account no later than the due date. Payments outstanding for 30 days or more will incur an additional interest of 2% per month (seen as our normal billing cycle month from roughly the 15th to the 15th of the next month), each month for the duration it is outstanding. This interest will be calculated as compound interest and will remain payable in full and seen as part of the invoice amount. All terms and conditions therefore set out above will be associated with these outstanding amounts as if it formed part of the initial invoice. Further to this, each follow up - consisting of a written notification via email or otherwise and a telephone call whether answered or not - required for any outstanding invoices will incur an admin fee of R100.00 ex VAT per follow up which will be added to the account at the next billing run whether the account is settled in full or not prior to this billing run.

Should any customer have any query relating to any invoice or part thereof, Easy IT will grant an extension of 7 (seven) days on the due data of any invoice in question. It is however the responsibility of the customer to obtain such extension in writing from Easy IT. Any invoice query not referred to our accounts department in writing within the first 7 days after the invoice was issued will be seen as an attempt by the customer to delay payment. If no prior written agreement between Easy IT and the customer has been obtained by the customer , any outstanding amounts on any of the invoices in question will be handled as per our normal interest terms and conditions as set out herein, whether the query resulted in crediting of the customers' account or not.

No cash or refunds will be provided under any circumstances, credit will however be provided to a specific customer account should it be agreed to in writing by Easy IT to do so. Any credits provided will not have a compound or knock on effect to any other action set out in these terms and conditions. The client accepts that any and all services or items were provided and delivered in good order prior to the invoice, service reports will however be provided on request. The customer accepts that should any further action be required to obtain payment for any services or any items rendered by Easy IT, that any and all such costs - legal and otherwise - will be for the customers' account.

Quote Terms and Conditions

All quotes and prices are provided E&OE, are subject to change without prior notice, are merely an estimation as to the final costs based on the information at hand, are quoted ex VAT and any other applicable taxes and duties. Delivery charges may apply that are not expressly listed and these charges depend on stock location, delivery location and delivery time frame. The customer accepts that it is their responsibility to obtain these delivery charges in writing prior to delivery commencing. Only written quotes can be seen as "valid" offers and this validity period is only for 7 (Seven) calendar days from the day the quote was generated, If a quote has no date indicated, the date the original document was created will be taken as the date the quote was generated.

All quotes are subject to our Invoice and payment terms indicated on this website. Only written or electronic confirmation of quotes will be accepted as a valid offer to purchase. It is also accepted by the customer that all quotes need amendment during big project cycles and it is their responsibility to obtain such updated quotes in writing as it commences. Any additions to the original quote agreed upon verbally or in writing between Easy IT and the customer will be seen as valid and accepted based on the initial acceptance of the quote by the customer, it is therefore the customer's responsibility to obtain any such costs in writing from Easy IT.

The customer accepts that any images of any product supplied might not be accurate and up to date and that it is the customers responsibility to ensure that all quoted items meet all requirements the customer has, prior to accepting the quotation. All prices listed on our website(s) are to be viewed as "quotes" and these terms and conditions therefore apply.

All prices on this website is quote exclusive of VAT and subject to change without notice.
